Not exactly, but patents are on implementations, and in the realm of
software that does translate to code. Ideas are not patentable, only
their implementation.*

No, the entire argument is still valid regardless if you are talking
about code, patents, or copyright. The simple fact of the matter is
that MS would not be paying hundreds of millions of dollars to a Linux
company if they had any real IP issue with Linux. They would be
demanding money instead of forking it over.
