That depends on what you mean by Free and Open.

Is its OS primarily made of Free Software? Yes.
Does it have proprietary layers? Yes
Does it create and contribute to Free Software Projects? Yes
Does it incorporate DMR in its multimedia offerings? Yes

Has it ever denied any of this? No.
