They're not public, they're being made available if you pay.  They even
have Rob Enderle commenting on the action, so it gives you a clue.  The
publication is called "redmond developer news", which also gives another
clue regarding the spin direction.

The last thing the EU should do is to agree to this, as it will
effectively prevent Open-Source from competing effectively, whilst
giving the impression that the playing field has been levelled - it most
certainly has not.
