I think that's exactly what they are looking at.

Essentially, a federal judge just unsealed documents sent between
Microsoft's top executives and openly discussing severe flaws in
Vista.  Since none of these issues was listed in the latest SEC
filings, it could be a serious problem for those still working at
Microsoft when the investigators start digging.

The case could open a can of worms for Microsoft including becoming
the basis for OEMs altering or revoking OEM contract terms, since the
contracts in July were negotiated fraudulently.
