Because Comes versus Microsoft came about from the strong belief of some
states that the DOJ adopted a "pollyannish attitude" towards Microsoft's
willingness to obey the spirit of the decision. That Microsoft's
slap-on-the-wrist would not materially deter it from its behavior, but
merely alter its tactics.

Maybe not, but side deals are the bread-and-butter of the businessman.
And Microsoft is nothing if not a predatory business.
