It's possible Roy missed some of the artist's messages--remember, Roy
has said he uses a C/R system. Those are notorious for causing lost
mail. (Another reason to avoid C/R systems, if their being net abuse
wasn't enough...).
Of course, it shouldn't have taken *any* messages from the artist.
Honorable people don't rip someone off and then wait for them to notice
before stopping.
