I suspect that they could well do that, and would claim to offer some
kind of indemnity against some unknown patent threat, but promise that
if you use MS-Suse, then you'll be safe, so long as you pay a royalty to
MS every year to keep your indemnity current. It's a fear-based
business model, in fact, exactly the kind of business model software
patents are meant to encourage.
