A lot of people use avatars of fictional entities, but I'd say that
using your actual photo is quite close to identity theft.  If you're not
getting the response you should get from digg over email, I suggest you
call them up at their office.  Not sure where they're located, as it
(apparently) isn't posted on their website, and the domain name is
registered through a proxy registrar.  AnyWho lists several places when
you search for digg, but I think the most likely candidate is the one in
California, as that's where their servers are located.

Anyway, if you do get hold of them, remind them that their own terms of
service forbid impersonating others, which using your photo surely is.
The main point here is to get the jerk to stop doing it, but if digg
won't do anything, and the person in question doesn't answer you, I see
no other course of action than to turn it over to the police.  This may
only be a mild case of identity theft, but every such attempt needs to
be stamped out viciously.  At the very least he is using your photo
without permission, which I am sure is against some law, though I can't
remember which one at this time.
